The digital Products and Services offered by Smart Move iGung by Aline Tisato online or at any venue are supplied by her subject to the following express Terms.
Injuries and health disclaimer
It is your sole responsibility to check with your doctor or medical practitioner about your suitability for Smart Move iGung by Aline Tisato’s Products and Services and to obtain their written consent where necessary prior to making a purchase.
While we take care to ensure safe practice, there are inherent risks in any exercise programme and we do not accept any liability whatsoever for any injury or illness you incur through purchasing our Products. That also applies when taking any of our Services and/or when you fail to notify her of any existing injuries, health problems or special needs before attending an online or onsite session, class, workshop or course.
Notify us by email prior to purchasing any digital Products, such as video courses or eBooks, or Services, of pregnancy or any health problem or injury you may have. This includes, without limitation, cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma or other breathing difficulties; diabetes; epilepsy; or any allergy that may affect your participation in, or be exacerbated by, any Service offered by Smart Move iGung by Aline Tisato.
Notify us by email before attending or participating in any online or onsite live session, class, workshop or course of any new circumstances affecting your health that may affect your ability to participate, or be exacerbated through attending or continuing to use the Services.
You accept the risk of injury from performing Smart Move iGung by Aline Tisato digital Products and when using specialist equipment while participating in online and onsite live Services. You acknowledge that any advice provided by her does not constitute professional medical advice or a substitute for your own professional medical advice.
You agree that you must follow the instructions provided in Smart Move iGung by Aline Tisato digital Products and online or onsite live personal sessions. You accept responsibility for any injury arising or being made worse by your failure to do so.
Important waiver and liability statements
Your waiver
By purchasing digital Products and/or booking Services with Aline Tisato via our Site, online booking system or directly with us, you accept that, in consideration of being permitted to acquire a Product and/or participate in our Services, you covenant on your own behalf and that of any heirs and assigns not to sue us.
You waive and discharge us against all responsibility or liability for injuries, health issues, damages, loss or death resulting from your acquisition of or participation in any Smart Move iGung Method by Aline Tisato digital Products, sessions, classes, workshops or courses.
Our liability
Smart Move iGung by Aline Tisato excludes all responsibility and/or liability for injuries, health issues, damages, loss or death resulting from, or exacerbated by, your acquisition of our digital Products or participation in any of our Services.
Arriving on time
When attending any Service, including a live session, workshop or course online or onsite, please ensure you are on time as a courtesy to the practitioner.
If you are late, your session, workshop or course will still take place within the originally allotted time and you will be charged for the full Service. It is your sole responsibility to ensure that you are on time.
Booking and payment
Aline Tisato’s online booking facility shows the availability of Services on the date and time you select. Service availability changes as bookings are made or cancelled by clients. It is your responsibility to ensure that you have made your booking and payment correctly.
If you notify us within 24 hours of incorrectly scheduling an online or onsite session, class, workshop or course, the purchased Service will remain available for rebooking. No refunds can be given where you have incorrectly booked a Service or made a payment.
You can pay for your Services using Stripe, credit card or debit card. All prices are final and Services are non-refundable, except as detailed elsewhere in these Terms. Smart Move iGung by Aline Tisato reserves the right to change prices without prior notice. None of your credit card details are collected or stored on our server.
The Service or Services commence from and include the date of purchase, not the date of your first booking.
Our right to cancel bookings and alter scheduled times
Binding contract
Once you have purchased or booked a session, class, workshop or course, online or onsite, with Smart Move iGung by Aline Tisato, you will receive a welcome email together with a binding contract and disclaimer.
Once these are returned with your consent, a binding contract is formed and you confirm that you have read the agreement in full and understand and agree to its contents.
In the event of a Site error or inaccuracy, or practitioner unavailability, Aline Tisato reserves the right to cancel any confirmed session, class, workshop or course booking up to 30 minutes prior to the scheduled Service time.
In the event of cancellation, her only liability shall be to move your Service to another date or event, or allow the Service to be used by another family member of your choice.
All Services are subject to availability. We will try to accommodate your preferences, but this cannot be guaranteed. The schedule of Services is subject to change without notice.
If we cancel a Service you have booked, we will contact you by email or telephone and return your credit so that you can rebook at your convenience. It is your responsibility to check your emails, including your spam folder, and keep your contact details up to date.
If you book a Service to which your package or plan does not apply, you will be removed from that Service without notice. It is your responsibility to ensure that you have selected a Service appropriate to your plan.
Holiday periods, package freezing, extensions and sharing
Packages and plans cannot be extended or frozen free of charge because of closures or restricted hours during Bank Holidays or the Christmas period.
Packages may be used by family members only in cases of proven client illness or urgent matters.
Prices and expiry periods
All prices are subject to change without notice and special offers may be withdrawn at any time without notice.
All sessions, classes, workshops and courses:
- Are subject to our 24-hour cancellation policy.
- Are transferable to family members only in cases of proven client illness or urgent matters.
Regular sessions, classes, workshops or courses are valid for a maximum of 16 weeks from and including the purchase date, unless otherwise stipulated on the specific purchased item.
Special offers are valid for the period stipulated in the offer from and including the purchase date, unless otherwise stated. If you are unsure about the validity of a session, class, workshop or course, please contact us before purchasing.
It is your sole responsibility to check and keep abreast of the expiration date of your Services. We do not send expiration reminders.
Waiting lists
By adding yourself to a waiting list, you grant us permission to subscribe you to email reminders and notifications. This allows us to notify you if a space becomes available.
Personal belongings
All personal belongings forgotten during Aline Tisato’s Smart Move iGung sessions, classes, workshops or in-person courses remain your sole responsibility. We are not responsible for their theft, loss or damage, and you acknowledge that you cannot make a claim against us for any loss, theft or damage to personal belongings.
Entry
We reserve the right to refuse entry.
Force majeure
Smart Move iGung by Aline Tisato shall not be liable to you or deemed to be in breach of these Terms because of any delay in performing, or failure to perform, any of our obligations where the delay or failure is due to a cause beyond our reasonable control.
Such causes include, but are not limited to, acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, government restrictions, regulations, by-laws, prohibitions or measures, strikes, lockouts, industrial action or trade disputes, IT viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or machinery breakdown.
Severability
If any part of these Terms is found by a court of competent jurisdiction or another competent authority to be invalid, unlawful or unenforceable, that part will be severed from these Terms. The remainder will continue to be valid and enforceable to the fullest extent permitted by law.
Site usage and intellectual property rights
You may use the Sites and our Facebook, YouTube, LinkedIn and Instagram pages for personal and lawful purposes in accordance with these Terms. You are not permitted to copy or use material from our Social Media for any commercial purpose.
The intellectual property rights in all content supplied through our Social Media as part of the Products or Services, and in the Smart Move iGung by Aline Tisato brands, trademarks and logos (“Materials”), are owned by Aline Tisato.
Except where expressly permitted by these Terms, you may not copy any Materials, alter anything on our Social Media, create links to or from our Social Media without written authorisation, or remove or alter any copyright, trademark or intellectual property notices contained in the Materials or copies thereof.
“Smart Move iGung by Aline Tisato” is a registered trademark or is the subject of an application for registration owned by Aline Tisato. Please do not use our brand, logos or marks without a written licence.
You must not use our Social Media to post, upload or otherwise transmit material that is obscene, pornographic, threatening, menacing, racist, offensive, defamatory, infringes intellectual property rights or is otherwise unlawful.
You must not harass, stalk, threaten or otherwise violate the rights of others; misrepresent your identity or status; hack into our Social Media or related computer systems; make excessive traffic demands; deliver viruses; or forward chain letters or similar materials that could prevent others from using our Social Media or damage the reputation of Smart Move iGung by Aline Tisato.
We have no obligation to monitor the use of our Social Media. However, we reserve the right to disclose information as required by law; remove, refuse to post or edit information or materials; block access; and take any other action reasonably necessary to prevent a breach of these Terms or applicable law.
We may also cooperate fully with law enforcement and other relevant authorities in relation to investigations of suspected unlawful activity or network security violations.
Liability
You are referred to the important liability statement at the beginning of these Terms. You agree that your use of this Site and the Services is on an “as is” and “as available” basis.
Except as expressly set out in these Terms, we do not enter into conditions, warranties or other terms in relation to the Site, Products or Services, including implied terms relating to quality, fitness for a particular purpose or any guaranteed or predicted result.
The Site and Social Media may include links to external sites and co-branded pages. These links are provided to give you access to information and services that may be useful or interesting. We are not responsible for the content of those sites or pages, or for anything provided by them.
Subject to the important liability statement, we are not liable for any failure to comply with these Terms due to an event beyond our reasonable control, including the submission of incorrect information by you.
Your personal information
The use of your personal information is governed by the Smart Move iGung by Aline Tisato Privacy Policy, which forms part of these Terms.
Entire agreement
These Terms, together with our booking or waiting-list confirmation, constitute the entire agreement between the parties unless otherwise expressly agreed in writing.
Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with European law. The parties agree to submit to the exclusive jurisdiction of the European courts.
